News: Activision hit with class-action lawsuit for "deceptive and unlawful" conduct over Guitar Hero III's faulty sound output on Nintendo Wii.



Following up on our previous report with Activision's Wii edition of Guitar Hero III comes the obvious lawsuit over the monaural sound that the title put out. Despite the fact that Activision will be replacing the discs for free a lawsuit has been launched alleging that the publisher engaged in "deceptive and unlawful" conduct. The charges point out that the box for the Wii edition of the top-selling video game advertises Dolby Pro Logic II surround sound as the method of output.

The class-action lawsuit brought by Samuel Livingston of San Diego whom is represented by KamberEdelson, LLC, "seeks actual damages, individual restitution, equitable relief, civil penalties, costs and expenses of litigation, including attorney's fees, and all further relief available."

The recent announcement of the replacement discs has not dissuaded the suit because as the documents state Activision is still selling the title in it original form, even after admitting that the sound capabilities don't match those advertised. The re-mastered replacement discs aren't set to arrive until Early 2008.
